TERMS OF USE AGREEMENT
The following describes the terms on which you may have access to ExtremeVDub.com and Extreme Automotive Group LLC and its services and membership. If you have any questions about this Agreement, please contact us.
1. Foundation
ExtremeVDub.com is a copyrighted and registered website, the owner of ExtremeVDub.com is Extreme Automotive Group LLC. From Herein, Extreme Automotive Group LLC. and ExtremeVDub.com website will be referred as "ExtremeVDub.com"
2. Reservation
All information and pictures on the website of "ExtremeVDub.com" is reserved. All finished product that is shipped to a purchaser is reserved and copyrighted. Any duplication, copying, distribution of ExtremeVDub.com without a written consent is illegal, and charges will be filed towards the violator(s).
3. Customer Security
Customer(s), users and/or members of ExtremeVDub.com must agree to all the Terms and Conditions before using any services provided by ExtremeVDub.com
4. Pictures
All pictures may not represent the actual product, the pictures are for advertising purposes only.
5. Information Policies
Information regarding availability of products, prices, phone numbers, emails, etc., are subject to change without notice at all times. Charges, and policies may be changed by ExtremeVDub.com at its sole discretion.
6. Inspection
Buyer shall inspect and reconcile all inbound shipments from ExtremeVDub.com within seven (7) working days. Claims for shortages or damaged merchandise must be submitted to ExtremeVDub.com no more than ten (10) working days following Buyer's receipt of shipment.
7. Returns; Defective and Damaged Merchandise
Defective and freight damaged merchandise (but only where ExtremeVDub.com is providing shipment) may be returned to ExtremeVDub.com for full credit, but only upon verification by ExtremeVDub.com of such defect or damage. A Returned Merchandise Authorization ("RMA") form must be filled out by the Buyer and Approved by ExtremeVDub.com. Credit will be issued to Buyer upon receipt of the RMA form and the claim approval from the freight company.
8. Returns; Exchanges; Good Merchandise
Returns of good merchandise may be accepted by ExtremeVDub.com in its sole discretion under the following conditions:
1. Return/Exchange of merchandise in totally re-saleable condition, without markings on the original packaging will be restricted to extraordinary circumstances with prior approval from ExtremeVDub.com. Accepted return will be assessed a 25% restocking charge. Returned part number shall not exceed 15% of total annual purchase quantities.
2. Return/Exchange of merchandise in packaging that has been marked, relabeled or otherwise defaced will be restricted to extraordinary circumstances with prior approval from ExtremeVDub.com. Accepted return will be assessed a 30% restocking charge, except that ExtremeVDub.com merchandise returned in packaging that has been marked, relabeled or otherwise defaced will be subject to a 40% restocking charge. Returned part number shall not exceed 15% of total annual purchase quantities.
3. Merchandise classified by ExtremeVDub.com as TB (To Be Discontinued), or DC (Discontinued), may not be returned for credit.
4. Merchandise on sales promotion or inventory packages may not be returned for credit.
5. Buyer must pay all return transportation charges.
6. Buyer must obtain and complete an RMA form, issued by ExtremeVDub.com, for any good merchandise return or exchanges.
7. Returns/Exchanges will not be accepted under any circumstances after 15 calendar days after the ship date indicated by ExtremeVDub.com.
8. Any returns for non-fitment or quality issues will require high quality digital pictures of the products to be emailed to the account manager before an RMA is approved.
9. Order cancellations will take up to 48 hours after a cancellation is requested before the order is officially cancelled and money processed for return.
9. User and Member Information
ExtremeVDub.com owns any information you provide through your use of the website, including any information regarding your use of the Internet and the website. Subject to the terms of our Privacy Policy, ExtremeVDub.com reserves the right to reproduce and use such information for its own marketing or other purposes. Such information will not be sold or otherwise provided to any third party without your consent.
10. Indemnification
You agree to indemnify, defend and hold harmless ExtremeVDub.com and any others involved in creating the website, any Content from and against any and all claims, actions, liabilities, costs and expenses arising out of (a) your breach of any provision of this Agreement; (b) your breach of any representation or warranty you provide herein; (c) your posting/processing on the website (d) your use of the website and the services. (e) otherwise arising in any way out of your use of the website and the services. You shall cooperate fully in any defense of such claim. ExtremeVDub.com reserves the right to take exclusive control over the defense of any such claim.
11. Trademark
All trademarks, service marks and trade names appearing on this website are the property of their respective owners.

If you are affiliated with or working for an Auto Maker including but not limited to Acura, Audi, BMW, Cadillac, Chevrolet, Chrysler, Dodge, Ford, GMC, Honda, Hyundai, Hummer, Infiniti, Isuzu, Jeep, Land Rover, Lexus, Lincoln, Mazda, Mercedes, Mercury, Mitsubishi, Nissan, Pontiac, Porsche, Saab, Saturn, Scion, Subaru, Suzuki, Toyota, Volkswagen (VW) and Volvo., either directly or indirectly, and / or you are in any related group, and / or were formally a worker, and / or an attorney you can not enter this website and cannot go anywhere further on the website and must exit it immediately. You can not access any of its files and you can not view any of the web page files. 16. Termination
ExtremeVDub.com reserves the right to terminate this Agreement at any time for any reason whatsoever and to revoke any transactions on standby or your membership in ExtremeVDub.com and your access to the website, Content, services without prior notice to you.
17. Applicable Law and Consent to Jurisdiction
This Agreement will be governed by and in accordance with the laws of the State of Colorado, United States of America without regard to its conflicts of law provisions. You agree to submit to the personal jurisdiction of the courts of Colorado Springs, Colorado, United States of America for any cause of action arising out of or relating to this Agreement.
18. Shortened Statute of Limitations
You agree to file any cause of action arising out of or relating to this Agreement and your rights and obligations hereunder in Colorado Springs, Colorado, United States of America within one year after the cause of action arises. You agree that any action filed after this date is barred.
19. Right to Change Agreement
ExtremeVDub.com reserves the right to change this Agreement at any time. ExtremeVDub.com will post a notice of any change to this Agreement on the website. Your continued use of the website after any such change is made constitutes acceptance of and agreement to be bound by the terms of the Agreement as modified. Only ExtremeVDub.com can modify the terms and conditions of this Agreement and/or the Credit Schedule.
20. Severability
If any provision of this Agreement is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.
21. Entire Agreement
This Agreement constitutes the entire agreement between you and ExtremeVDub.com and supersedes all proposals and other communications made between the parties, written or oral. This Agreement can only be modified as stated in Section 19 above.
ORDER SECURITY
Security and satisfaction is our main goal. All information provided by you is confidential and will not be released to any third parties. To insure confidentiality, we use the SSL (Secure Sockets Layer) protocol (provider by Thawte) for transferring data. SSL is a cryptosystem that creates a secure environment for the information being transferred between your browser and our Server.

SHIPPING AND ORDER PROBLEM FAQ
Q: Can I have my order shipped to an address different from the billing address?
A: No. We will only ship orders to the Billing Address. If the billing address you provide is not on file with your credit card company, it might cause unnecessary delays. Please make sure that you clear this with your company before submitting the order. Most deliveries will require a customer signature.
Q: How much will shipping be for an item?
A: You can estimate ground domestic shipping costs by inputting your zip code after adding your item to your shopping cart. We have a domestic Shipping Estimator for ground UPS on the first checkout page. Just input your Zipcode to find out how much ground shipping will be.
Q: What Shipping Methods do you use?
A: For Domestic Shipments within the 48 Continental US states our default shipper is UPS, but we may use other methods (Fedex, DHL, USPS) as appropriate. Available shipping methods may vary for different type of products. If the merchandise you purchase is in stock, it is guaranteed to be shipped the next business day, after which its delivery can be tracked through the shipper's website. Some made-to-order products, for example dash kits, and special-line brands such as Koni, take on average 5-7 business days to manufacture before they are shipped out.
For International Shipments we use USPS.
Q: Do you offer combined shipping?
A: Our shipping costs are on a per-item-basis. If you are ordering multiple items and would like a combined shipping cost please give us call or email us to check and place your order over the phone.
Q: How long does it take to ship an item?
A: Once payment is received and if the item is in stock, within 3-5 business days. If there are inventory problems or the item is rare or made-to-order, you will be contacted about the delay.
All items are usually in stock, however there may be a chance that delays will occur if the item we thought was in stock (shown on our inventory sheet) is actually not in our warehouse. In this situation, we will need to order it directly from the manufacture, and we will have to wait until the manufacture delivers the product to us (usually within a week or two). You will receive an email from us on explaining the delay if this situation occurs. Some made-to-order products, for example dash kits, and special-line brands such as Koni, can take up to 10 business days to manufacture before they are shipped out.

Q: Do you ship to International Customers?
A: Yes. Items being shipped internationally are shipped using USPS to certain countries only. We are not responsible for delays in customs or any other additional charges that may occur. This may include tax, duties, etc. Final shipping costs will be displayed on the Invoice you see before confirming your order. Expected delivery time is 7-10 business days from the date of order for all normal processing period products. Please call us or email us before placing your order when doing an international order and we can give you a shipping, customs and handling quote.
Q: Do you ship to HI, AK, PR, Guam, US Virgin Islands, and APO, FPO and PO Box?
A: Yes. We ship to HI, AK, PR, Guam, US Virgin Islands and APO, FPO, and PO Boxes, with a possible additional charge. Please feel free to request a quote via email or phone before placing your order for an exact shipping quote.
Q: What happens to my order if it was refused or undelivered?
A: Refused or undeliverable shipments will not be granted a refund. Returned shipments will be held until a $10 handling fee and funds to cover re-shipping are paid. If during a UPS shipment, an address change occurs through no fault of us, we expect you will honor a $10 charge (charged to us by UPS).

Q: What happens if a product I order is on backorder?
A: In rare case backorder could occur. If you are not willing to wait, we understand and will promptly issue a refund to you in the same method you made your payment. You will be advised via e-mail of any item that is on backorder.
Please inspect your delivery immediately. We must be notified within 24 hours. Backordered items will ship separately. Please inspect the packing list. If shortages are found, please inspect box for split, crack or tears. If an item is missing, please notify the shipper and ExtremeVDub.com immediately. Failure to do so limits our ability to correct the situation. Shipping companies require immediate notification for inspection.
